Welcome to Upscape. These Terms of Service ("Terms") govern your use of getupscaped.com and the landscape lighting design and installation services provided by Upscape, LLC, a Connecticut limited liability company ("Upscape," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.

About Us

Upscape, LLC is a landscape lighting design and installation company based in Westport, Connecticut, serving Fairfield County, Connecticut. We are a licensed Connecticut Home Improvement Contractor (registration HIC.0706288) and carry general liability insurance of $1,000,000 per occurrence / $2,000,000 aggregate. Proof of registration and insurance is available on request.

Our Services

Upscape specializes exclusively in low-voltage (12V) landscape lighting — design, installation, and ongoing service. Any work outside this scope (including line-voltage electrical work) is performed by, or referred to, appropriately licensed contractors. All electrical installation on our projects is performed by our licensed Connecticut electrical contractor, who pulls any required permits.

Estimates and Proposals

Estimates and proposals are non-binding until formalized in a written agreement signed by both parties. Pricing may be adjusted based on site conditions, material availability, and design decisions made before or during the project. Any change to an agreed scope will be documented in writing.

Scheduling and Site Conditions

Project timelines are estimates and may be affected by weather, material lead times, and site access. You are responsible for providing safe, reasonable access to the work area and for identifying any private underground utilities, irrigation lines, or landscape features that are not publicly marked.

Licensing and Insurance

Upscape, LLC is a registered Connecticut Home Improvement Contractor (HIC.0706288). Landscape lighting installation is regulated as electrical work in Connecticut; accordingly, electrical installation is performed by our licensed Connecticut electrical contractor. Our services and insurance coverage are provided within the State of Connecticut only.

Warranties

Lighting fixtures and equipment carry manufacturer warranties, which we pass along to you. We stand behind the quality of our installation workmanship. Except as expressly stated, services are provided "as is," and we make no other warranties, express or implied.

Limitation of Liability

Upscape is not responsible for damage arising from weather, landscaping or construction work by others, pets, accidental impact, utility or power failures, or modifications made by third parties after installation. To the fullest extent permitted by law, Upscape is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any rights you have under the Connecticut Home Improvement Act.

Maintenance

We offer optional ongoing maintenance and service. Maintenance visits are scheduled separately and may be subject to additional charges, which will be disclosed in advance.

Third-Party Links and Tools

Our website may contain links to, or tools from, third parties (such as scheduling, analytics, or payment services). We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their terms.

Your Cancellation Rights

For home improvement work, Connecticut law gives you the right to cancel a signed contract within three (3) business days of signing. Cancellation details are provided with your written agreement.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Continued use of our website or services after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the jurisdiction of the state and federal courts located in Connecticut.
